notes
Terms and conditions, also known as terms of service or user agreements, are legal documents that outline the rules and regulations for using a particular product or service. These documents have become a ubiquitous part of our daily lives, as nearly every website, app, and service we use requires us to accept its terms and conditions before we can access it. The origins of terms and conditions can be traced back to the early days of the internet, as a way for companies to protect themselves from legal liability for user-generated content. As the internet became more widespread and the number of online transactions increased, terms and conditions became a necessity for businesses to protect themselves from potential lawsuits.
The effects of terms and conditions on our daily lives are far-reaching. They govern everything from how we use our smartphones to how we interact with social media platforms. They dictate what we can and cannot do with the products and services we use, and they also outline the legal rights and responsibilities of both the user and the company providing the service.
There have been observed consequences or impacts when ToCs are implemented, particularly when it comes to the lack of understanding of these documents by the users. This can lead to tragedy, as in some cases, people have unknowingly agreed to terms that have led to the loss of personal information or even financial ruin. One example is the Cambridge Analytica scandal where the data of millions of Facebook users were harvested without their consent due to a lack of understanding and knowledge of the terms of service.
The concept of terms and conditions can also be seen in religious literature, particularly in the book of Genesis in the Bible (Genesis 2:16-17). The story of Adam and Eve in the Garden of Eden is often interpreted as God providing terms and conditions for the first humans. They were allowed to live in the Garden but were warned not to eat from the Tree of Knowledge. This story serves as a reminder that with any gift or privilege comes responsibility and limitations. It’s worth mentioning that the reason why the apple is often represented as the fruit of the Tree of Knowledge is that the word “apple” was used as a generic term for all fruits. This representation is a metaphor to symbolize the forbidden fruit that Eve was tempted by Satan to eat from the tree.
